Terms of Service

1. Eligibility and Accounts

You must be legally capable of entering into a binding agreement to use the Services. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it current.

2. License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use unless we expressly agree otherwise in writing.

3. Acceptable Use

You agree not to:

• Use the Services in violation of law or regulation.
• Cheat, exploit bugs, reverse engineer, scrape, or interfere with the Services.
• Upload or transmit malware, spam, infringing content, or material that is unlawful, abusive, defamatory, or harmful.

• Use bots, automation, or unauthorized third-party tools except where we explicitly allow them.

4. User Content

If you submit, upload, or post content through the Services, you retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise use that content as needed to operate, improve, promote, and provide the Services.

You represent that you have the rights necessary to provide your content and that it does not violate the law or the rights of any third party. We may remove content at our discretion.

5. Purchases, Virtual Items, and Subscriptions

Some Services may offer paid features, subscriptions, downloadable content, or virtual items. Prices and availability may change at any time. Except where required by law, all purchases are final and non-refundable. Virtual items are licensed, not sold, have no cash value, and may be modified or discontinued at any time.

If you purchase through a third-party platform such as the Apple App Store or Google Play, that platform’s billing terms also apply.

6. Intellectual Property

The Services, including all software, code, design, text, graphics, audio, video, gameplay systems, trademarks, logos, and other content, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

7. Beta Features and Playtests

We may offer alpha, beta, early access, or playtest features that are incomplete, subject to change, and may contain bugs or downtime. We may suspend or end such programs at any time without liability.

8. Third-Party Services

The Services may include links to, integrations with, or functionality provided by third parties. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

9. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for us or other users, or where needed to protect the Services or comply with law. You may stop using the Services at any time.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law. We do not guarantee that the Services will be uninterrupted, error-free, secure, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, Foldable and its affiliates, officers, employees, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to the Services or these Terms. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the applicable Service during the twelve months before the claim arose or one hundred U.S. dollars (US$100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Foldable and its affiliates, officers, employees, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising from your use of the Services, your content, or your violation of these Terms or applicable law.

13. Governing Law

To the extent permitted by law, these Terms are governed by the laws of the State of California, without regard to conflict of law rules. You agree that any dispute not subject to mandatory arbitration or small claims jurisdiction will be resolved exclusively in the state or federal courts located in California, and you consent to those courts' jurisdiction.

14. Changes to the Services or Terms

We may modify the Services and these Terms at any time. Updated Terms become effective when posted or as otherwise indicated. Your continued use of the Services after the effective date of revised Terms means you accept the updated Terms.
